Welcome to Sprachtandem.ch, an online service that allows you to find tandem partners for learning and practicing foreign languages. By using the service of Sprachtandem.ch you accept the following terms and conditions. Sprachtandem.ch reserves the right to change the terms of use without further notice. You have the possibility to read the terms and conditions regularly to be always up to date. Being active on Sprachtandem.ch implies that you agree to all the terms and conditions.

Your acceptance of and compliance with these Terms will govern your access to and use of the Service. These Terms apply to all visitors, users and others who access or use the Service. You agree to be bound by these Terms by accessing or using the Service. If you do not agree to any part of the Terms, you do not have permission to access the Service.

Liability

Your use of the Service is at your own risk. Any liability in connection with the use of the website is disclaimed. No liability is assumed for the content of users. Sprachtandem.ch strives for the highest possible quality of the service. Unfortunately, however, we cannot guarantee that a) the Service will be uninterrupted, secure, or available at any particular time or location; b) errors or defects will be corrected; c) the Service will be free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Use

A user account is required to use the Service. A user account can be created free of charge. The information, except for the e-mail address and password, is visible to other users. A selection of basic functions is available to all accounts. Premium functions can be added to the account against annual, monthly or weekly payment. To prevent misuse of the messaging function, the maximum number of new conversations is limited to 4 conversations per month for free users and 100 conversations per month for premium users. The account may only be used by the registered person and may not be passed on. The platform may only be used within the usual framework and for the intended purpose.

Development, Modification And Improvement Of The Services

Our Service is constantly being updated and changed. To accomplish this, we may change some or all parts of the Service. For example, we may update or remove features, offer new services, or discontinue outdated services. Adapting to new technologies, changing the number of User:s of a particular feature, service or product, making material changes to licenses or partnerships with third parties, preventing abuse or harm, implementing legal or regulatory requirements, or resolving security-related issues are other reasons we may change the Service. We also make changes that are necessary to maintain legal compliance of our Service. We make these updates to our services to maintain the expected level of quality and to address security concerns.

Notifications And Service Messages

When new chat messages are received, users will be notified by email. Notifications of Sprachtandem.ch news can be customized in the profile.

Termination

Until the end of the paid term a premium membership can be cancelled via the corresponding function in the account. The membership will be automatically renewed for the previous paid term if not cancelled. The costs will be charged accordingly.

Code of Conduct

When using the platform, the following code of conduct must be observed:

  • Respectful behavior
  • No spreading of racist, sexist, commercial, obscene, illegal or otherwise disturbing content
  • No political or religious topics in the public area
  • No sending of harassment or spam to other users
  • No distribution of pornographic content
  • No technical manipulation of the website
  • No identity theft
  • No crawling of user data

A violation or even a suspicion entitles the operators to block your account without prior notice. Amounts already paid for a premium account will not be refunded.

Users take responsibility for published content and are only allowed to use content for which they own the copyright. By publishing Content on or through the Service, you represent and warrant that: (i) the Content belongs to you (you are the owner:in) and/or you have the right to use it and grant us the rights and licenses provided in these Terms; and (ii) the publication of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or other rights of any person or entity. We reserve the right to terminate the account of any person who is found to be in violation of any copyright.

Privacy

The collected data will be used only for the optimal operation of the website. Messages between users are not encrypted. Please refer to Privacy Policy for details.

Warranty

For the duration of the paid subscription, a server availability of 80% of the time is guaranteed. A lower availability does not lead to any claims against the operator of the website.

Termination And Withdrawal

We may, in our sole discretion, immediately suspend or terminate your account and deny you access to the Service for any reason, including but not limited to a violation of the Terms, without prior warning or liability. You may delete your profile at any time if you so choose. If you delete your Premium Account, your subscription to any Service for which you have paid will end. Refunds are not available for this subscription due to its nature.

Changes

We reserve the right to change these Terms at any time and in our sole discretion. In the event of a material change, we will notify you at least 30 days prior to the effective date of the new terms. We reserve the right to determine what constitutes a material change. You agree to be bound by the updated Terms if you access or use our Service after the effective date of the changes. You will no longer be able to use the Service if you do not accept the new Terms.

Waiver and severability clause

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. If any provision of this Agreement is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified to be as enforceable and effective as possible to carry out the intent of the provision; and if a court or arbitrator finds the modified provision to be invalid, illegal, void, or unenforceable, the validity, legality, and enforceability of the remaining provisions of this Agreement will not be affected in any way.
